Mission Statement

The Land Use Inspector is responsible for helping the public deal with issues regarding Planning & Zoning, Zoning Board of Appeals, and Inland Wetlands.
The Land Use Inspector provides residents with the proper applications and information in order to do various home improvements. For example, pool permits, additions, decks, garages, sheds, etc.
A Zoning Permit is needed to build a home in Prospect, add a new subdivision, and home occupation. Any time the area of a structure is going to increase or change, a Zoning Permit is required.
Additionally, the Planning and Zoning Commission must approve permit applications for Residential Home Occupations and Changes of Use for Business Properties.

The staff of the Land Use Office provides technical assistance to the Planning and Zoning Commission, Inland Wetlands Commission and the Zoning Board of Appeals. The staff also answers public inquiries regarding planning, development and land use regulations. The staff provides contractors with application forms and information in order to apply for permits and variances.

NOTICE:

Effective October 1st, 2021, Sections 3 and 4 of Public Act 21-121 revise the notification processes of Sections 8-3i and 22a-42f of the Connecticut General Statutes (CGS) to require electronic notifications (rather than mail as previously required) to DPH whenever an application, petition, request or plan is filed with the zoning commission, planning and zoning commission, zoning board of appeals or inland wetland agency for any regulated activity or project on any site that is within the aquifer protection area or the watershed of a public water supply. The applicant is required to provide the electronic notice not later than seven days after the date of the application.

A form and mapping application have been provided online to assist applicants in complying with
these requirements.

Public Water Supply Watershed or Aquifer Area Project Notification Form

All applicants before a municipal Zoning Commission, Planning and Zoning Commission, Zoning Board of Appeals, or Inland Wetlands Agency for any project located within a public water supply aquifer or watershed area are required by Section 8-3i and Sec. 22a-42f of the CT General Statutes to notify Connecticut Water Company of the proposed project by certified mail not later than 7 days after the date of the application. The notice should be sent to: Jessica Demar, Environmental & Regulatory Compliance Coordinator, Connecticut Water Company, 93 West Main Street, Clinton, CT 06413 by Certified Mail, Return Receipt.

ZONING PERMIT APPPLICATIONS CANNOT BE FILED ELECTRONICALLY ON THE TOWN WEBSITE AT THIS TIME.

BUILDING PERMIT APPLICATIONS ARE THE ONLY PERMITS AT THIS TIME THAT MUST BE FILED ELECTRONICALLY ON THE TOWN WEBSITE. ALL ZONING PERMITS MUST BE PRINTED OUT, FILLED OUT AND DROPPED OFF OR MAILED TO THE PROSECT TOWN HALL, LAND USE, 36 CENTER STREET, PROSPECT, CT 06712, ALONG WITH FEES EITHER CASH, CHECK OR MONEY ORDER.

THE LAND USE DEPARTMENT DOES NOT ACCEPT DEBIT OR CREDIT CARD PAYMENTS.

PLEASE NOTE THAT NOT ALL ZONING PERMIT APPLICATIONS ARE ON THE LAND USE DEPARTMENT PAGE AT THIS TIME.

DO NOT APPLY FOR A BUILDING PERMIT OR PAY FOR A BUILDING PERMIT UNTIL YOU RECEIVE ZONING APPROVAL. PLEASE BE AWARE THE LAND USE INSPECTOR HAS 65 DAYS FROM THE DAY OF RECEIPT OF A ZONING PERMIT APPLICATION TO RENDER A DECISION. IT MAY NOT TAKE THAT LONG BUT PLEASE BE PATIENT.

Stormwater Management

The Town of Prospect currently implements many of the elements of a successful Storm Water Management Program. In order to fully comply with the National Pollution Discharge Elimination System (NPDES) storm water regulations and the Connecticut Department of Energy &Environmental Protection's (CT DEEP) Phase II Storm Water Program, the Town must implement additional measures. The following table (also found in Appendix K) outlines those measures, identifies the responsible parties, measurable goals, and provides a schedule for implementation over the five year permit term. The listed measures were identified through workshops conducted with the Town. Technical Memorandums (TMs) were prepared for each of the six minimum control measures. At these workshops the TMs were reviewed and implementation alternatives were discussed. Where possible, the measurable goals are presentedas discrete activities. For these, the conduct of the activity is intended to serve as the goal.
